Hongkong, 12th March, 1889 I have the honor to enclose to some Memoranda trawn up, as I was informed when they were given into my charge, by Mr May, Superintendent of Police in this Colony, upon the contents of certain papers seized at the time that the Convict Mon Isoo. Wong was taken into custody. I shall with your permission explain, at length how it has happened that the Memoranda in question have not been Earlier produced. I must premise that, throughout, my statements are made to the best of my belief in their correctness, The Honorable M. J. Mereer Esquire Colonial Secretary and that I cannot undertake to -positively for every detail. It was, I think, in the autumn of 1837, return from Calcutta, whether I had accompanied Lord Elgin, that I was requested by His Excelleney Sir John Bowring. The Governor of this Colony, to examine a large collection of Chinese books and papers a Memo: had been prepared by tr May. They had already been examined by Mr Mongan then a Student Interpreter, and in charge of the Chinese Secretary's : office during my absence with the - Mission, and had not been forna by that gentleman to contain certain important papers noted in Ax May's Mem", and gravely reflecting the character of Mr Caldwell. It will be in recollection that Although not in the service of the Colony, I have never made any difficulty about undertaking the work of translation or interpretation in its behalf, when called and I have lent one ground of hesitation in this instance.. The bulk of these papers, which filles four or five large baskets, was such that the task winea be a most laborious one, and uncertain as I was about the - Movements of the Mission, and occupied time had already been promised to lee, I felt doubts about accomplishing it, were I to commence it. and Dr. Bridges, then Sir John Bowring Acting Colonial Secretary, both auten me more than once about the progress case that the moment I coned of my investigations and my reply was, the time I wonen go papers, but that the operation which it would not do to leave half finishes, while from the presties Acumatinas peculiar of the case I could neither invite assistance in it, nor delegate to others any portion necessary enquiry. I may add that it was my Conviction, and I believe I expressed it, that nothing wooned result of advantage to the point to be established, from examination of these papers. Mr Moongan though Many years my junior. Chinese, perfectly equal to the duty- entrusted to him. He knew a great deal too much chinese to have passed by such papers as the missing documents without notice, and I was, and Am, perfectly satisfies that either the papers have not been in the Collection when it was "looked over by Mr May and his - or, if they were then in the interpreter, or if they Collection, have been withdrawn from its before it was places in ottr Moongan's hands. I beg to be understood to cxpress as to whether the charge mode made, or the papers in support- of the charge made frandulently abstracted It is enough to say that I felt shoes find nothing that Mr Mongan- hen not found. However, for Security's sake, I kept the baskets seated and corded in room and the Memoranda in the lid. of my despatch box, and seeing at length, of my departure, that I shoes on the eve not have leisure to examine them I had the baskets carried to the Chinese Secretary's office there to abide the orders of the Governor. The place of the - Mem?: (which must have been all the while in my dispatch box, ) I had forgotten, and was obliged to inform the Acting Colonial Secretary at the last moment that I had mislain them. I must since have haw them in once but did not notice them, to the leeet of my recollection, until some time in November or December last, the Yang tez- Kiang .- On my return to Shanghai, last January, I happened to observe my name in a one of the cases connected with these papers tried before the Supreme Court made to the missing found reference Memoranda. I at once Communicated to you in a private note the fact that the Memoranda were in my possession and shmen have carlier ~forwarded to you the letties of Explanation, which, as I then states, I has drafted to cover the Memoranda now enclosed. Circumstances prevented its transmission as I had intended, and in the time I have received a note mean a G. Bridges enclosing, in printing form, Certain portions of statements made by himself he fore the Mr Anstey and Count of Enquiry which sat last Summer, and requesting me to declare whether his or Mr Anstey's version of articular incident is the correct - partionlov I trust that I am guilty of no impropriety in availing myself of this opportunity to attempt an adjustment of the discrepancy to which Ir Bridges has drawn my attention. Dc Bridges states on the 15th Febuary, "I recollect it as being the day "French Captain was buried, I was " with Mr Wake three or four hours. lee " haw some tath about the Ma-chow Mong "Case, and I distinctly understood from him that he had made no investigation of the books, and had no intention of doing so. And again." Mr Wade Never made "Any report to me as Acting Colonial "Secretary, of the contents of the books " and papers, after the Excentive Conneil hoa determined not to pardow alba- chow wrong, did not intend to make "Any." Mr. Anatey States "I heard Heis "Eccelliney State on the 10th attimo, as "recorded in letter of the 13th, that the reason why Ma- chow trong was not pardoned doned was that his accounts and "were ascertained to contain such evidence as to make " of the man's systematic quilt " his pardon impossible, Mr Caldwell "having denied that they contained " evidence of guilt, it llows that len 1 follows " May's two Memoranda and Mr Wake's "cutificate "Certificate were the materials which " His Excellency bad before him, and on " which he formen his judgment. I know that these memoranda veure in existence "Within a week be before M. Wade proceeded "with Lord Elgin to the North. Mr. "Wave and I had a long Conversation "about them and their contents about that time, and he told me there was "no doubt that the Accounts and contained the evidence of the Convicts guilt. "He further states . "By the by I have my certificate upon the whole finishen "of those papers"," added either "that he had sent them in or that he wooned send them in without delay ? It is quite certain that I did not- any report upon the papers examined by Mr Mongan. I have shewn above why I did not, but I kept the papers until the lask moment in the hope of having interval of leisure which never came, and. abandonment ultimately of my intention to examine them was I must think, due to this circumstance, and not, as Dr Bridges believes me to have slated, to the determination of the Council to let the law latte its course with Ma Isoo Wong. This is, however, a Minor point of interest chiefly to myself. Gr. Bridges is perfectly correct in his main fant viz: that no report was made and the intention of making one relinquished. I need not demonstrates that Mr. was equally correct in starting that the Memoranda now enclosed follows, were in existence when I proceeded noth with Lord Elgin. But in what respecting a long conversation upon ther contents, in which I am beleived to have sain that the accounts and papers contained beyond doubt evidence of the convicts "am obliged to assume that any such remarks on my part has reference not to the papers of which Mr May's Memorands are a sort of index, but to another collection Concerning what is known as the Beaver Case. I perfectly well remember, just before General Ashburnham's de departures in as I was in the act of preparing letter to the governor upon some papers. which had been asked my opinion His Excellency, that he sent while the Excentive Council and that I read to the Council hea letter, and made some unfinished letter, statements on which, if I mistate not, the Council decided that there was no ground for extending to elba $200. Wong the indulgenes which it has been in contemplation to shew him. Aby impression is that these were the papers of the Beaver case, and although the matter of them and their particular the case of the Convict have: entirely passed from my recollection, I make little doubt that it was on these that I told Mr Anstey in some Conversation or other that I had My certificate, i finished probably my report. This supposes of course a Confusion of dates on the part of ells Anstey, but, with every confidence in Mr Anstey's powers of memory, :fully admitting the defectiveness with which I am in this instance compelled to charge my own, I must be allowed to assume his anachronism to be - greater possibility than that I shores have told him my report was ready on papers which I certainly never looked into In conclusion I leeg to express my instrumentality regret that through my documents of so important a character shonea have been so long withheld from the department to which they belong. I have the honor to be, &c. (Signed) Tomas Wade, Chinese Secretary & H. B. M. Plenipotentiar (Frue copy) in China. Bolonial Secretary. Inclosure No in Despatch No 64 of 1859 Mr May's Memoranda.
