THE FINANCES OF HONGKONG,
The prosperous condition of the Colony, as shown by the figures laid before the Legis. lative Council by His Excellency the Gover NOR yesterday afternoon, is highly satisfac- tory. It will be remembered that Mr. Hes- NESST in an equally long and lacid speech last November foreshadowed this result, and yesterday, in a speech of over an hour's duration, he stated the actual receipts thus far and the probable revenue, from various sources, of the rear. The GOVERNOR had estimated that this year there would be a total surplus of revenue over expen- diture of $71,954, but in the uine months the receipts show an excess of $85,923, If, therefore, the year finishes as prosperously as it began we shall have a surplus of revenue over expenditure of not less than $114,000. This is the more gratifying since, as His Excellency pointed out, in England times are bad, trade is depressed, and affairs gene- rally are unfavourable. In China, famine has plunged several of the Northern provinces into the deepest distress, while even in Kwang-tung Bood and famine have deso- lated extensive districts and thrown thoa- sands of people on public charity. The flourishing condition of the Colony is not, consequently, due to any exceptional pros- perity at home or in China.
Turning again to the figures placed before us by His Excellency, the increase in revenue is apparent on several items. In the Crown rents, junk licences, stamps, postage, light dues, &c., there is a substantial increase, considerably in excess even of Mr. HENNESSY'S sanguine anticipations. Thus the receipts from postage, which at last year's rate would be $47,000, for the nine months, actually foot up to $66,492, or nearly four thousand dol- lars in excess of the total amount for last year. The sum realised from stamps for the ning
months is nearly six thousand dollars more than in the same period last year; while that derived from light dues during the same months is only about one thousand dollars less than the total revenue for the whole year in 1877. As a proof that native trade has not been declining, the junk liccuces also exhibit an increase of over a thousand dollars. The increase in the income derivable from Crown rents--some $105,000 in nine months -is an evidence that additional land has been taken up in the Colony; and as a tutter of fact there have been a uniber of new houses erected both in the City of Victoria and up at the Peak. With regard to the Opium Farm, His Excellency entertains hopes of securing a much larger rental, and be has a project for establishing a Spirit Farm, which would likewise be a source of profit.
Altogether the financial prospects are very encouraging, and we must congratulate His Excellency and the community alike upon the fact. The GoVERNOR yesterday expressed his intention of lightening the burden of taxatiou, and we shall be glad to see this carried into effect. The taxes are very high in Hongkong and press heavily upon all, but more especially upon those who have fixed in- comes. Now that the revenue of the Colony is in so buoyant a condition, some reduction can be safely made. In these days of com petition we want the cost of living cheap- ened as much as possible, and at reduction in taxation that can be effected without im- pairing the efficiency of the public services will be most acceptable. Last year we had the pleasure of speaking in terms of approval of Mr. HENNESSY's Budget, and his state- ment this year is even more satisfactory, in- asmuch as he can speak of results achieved. His Excellency's forte evidently lies in finance, and on this point, at all events, we think the community-whatever their views of his! policy in other matters-will not be inclined to find fault with his administration. In all probability there is a great career before Mr. HENNESSY as a financier. It is a pity he should allow his visionary humanitarian views to so materially impair his usefulness here.

By the Market Ordinance 1858 section VIII sales of articles of food subject to certain exceptions
prohibited elsewhere than in the publie Market. The present Ordinance was
framed. for the purpose of enabling the Governor to grant licences generally for the sale of food elsewhere than in the public Market. Applications had been made to the Governor for this purpose previously to the passing of this Ordinance (especially one by a European
for the opening of a butcher's shop) which it was considered would have been of benefit to the public buit which having regard the provisions of the Market Ordinances could not be granted.

Objects and Reasons.
The principal objects of this Ordinance are to impose some check on the outgoing opium farmer to prevent him from manufacturing or disposing at or near the end of his term excessive quantities of boiled or prepared opium to the detriment of the new opium farmer and of the revenue, and to give to the opium farmer increased facilities for his protection from competition by unauthorised persons.
Section 1 defines "Excise Officer" and "possession." Section 2 provides that no opium farmer or his licensee shall dispose of prepared opium at or near the end of his term or at any other time authorising the use of such pre- pared opium after 12 o'clock of the 3rd day after the com- mencement of the term of the succeeding farmer.
Section 3 provides that public notice shall be given by the outgoing farmer previous to the cessation of the term for which he holds the exclusive privilege of boiling and preparing opium and selling and retailing the same and that no boiled or prepared opium may be lawfully used after the date mentioned in such notice without the consent of the incoming farmer.
Section 4 provides that the outgoing farmer shall hand over his stocks of opium to the incoming farmer at current prices.
Section 5 provides that the opium farmer shall not at or near the end of his term manufacture more than the usual quantity of opium nor sell prepared opium at less than current price or in larger quantities than usual at the time of year, nor sell, export, &c., any of his stock of prepared opinm, but make over to the new farmer all his stock at marketable value and in the event of differences arising between the outgoing and incoming farmer in respect of this or the 3rd section provides for a reference to arbitration. Section 6 amends section 8 of Ordinance 2 of 1858, and is intended to make it clear that no person is permitted to use prepared opium purchased from à farmer whose privi- lege has expired. A proviso is introduced for the per- mitting small quantities to be used purchased from the old farmer or his licensees for a limited period after the com- mencement of the new farmer's term.
Section 7 permits the seizure by an Excise or Police Officer of prepared opium found in the possession of un- authorised persons or in unauthorised places and also of utensils and vessels used or manifestly intended to be used for boiling or preparing opium.
Section 8 provides that where prepared opium is found in the possession of any unauthorised person or in any unauthorised place and utensils or vessels for boiling or preparing opium are also found in the possession of such

Section 9 provides generally that where there is reason- able ground to believe that opium is boiled or prepared by any unauthorised person or in any unauthorised place any raw opium found in the possession of such person or in such place may bo seized by an Excise or Police Officer,
Section 10 enables a Justice of the Peace to issue a Search Warrant as well as a Magistrate to any Police or Excise Officer and authorises the person executing the warrant in addition to seizing boiled or prepared opium as provided by Ordinance 2 of 1858 section 9 to seize utensils or vessels for boiling or preparing opium and also where such utensils or vessels are found to seize any raw opium that may be found in the possession of any person having such prepared opium or utensils, &c., or as may be found in any such place. Section 11 authorises the Governor to appoint Excise Officers on the nomination of the opium farmer.
Section 12 provides that the names and places of resi- dence of Excise Officers shall be posted conspicuously at the Police Court,
Section 13 enacts that Excise Officers shall be provided with badges which are to be produced when they are about Police Officers when to act as such Excise Officers. acting as Excise Officers are also to produce some part of their public equipment.
Section 14 removes any doubt existing at present by providing that penalties may be recovered summarily before à Magistrate.
Section 15 applies to and authorises proceedings to be taken when prepared opium or utensils or vessels for pre- paring the same are found apparently in the possession of no one, and provides for the forfeiture of raw opium found at the same time and place.
Section 16 provides for the forfeiture by a Magistrate of raw opium found in the possession of unauthorised persons or in unauthorised places where it appears to such Magis- trate that raw opium has been boiled or prepared by such unauthorised person or in such unauthorised place and enables him to deliver such raw opium to the opium farmer. Section 17 enables the present farmers to terminate their term by giving a month's notice to the Colonial Secretary within one month from the time this Ordinance comes into operation otherwise present arrangements to continue subject to the provisions of the Ordinance.
Section 18 provides that this Ordinance shall be con- strued with 2 of 1858, and may be cited as "The Excise Ordinance, (Opium) 1858-1879,"
